1. Who controls your data

Performance Chef Academy is a trading name of Kognique Holdings LLC, a limited liability company registered in Wyoming, United States, with its registered address at 1021 E Lincolnway, Unit 443, Cheyenne, WY 82001, United States.

Kognique Holdings LLC is the data controller for the personal data described in this policy.

We have not appointed a UK or EU representative under Article 27 of the UK GDPR. This is under review.

2. What we collect

- Identity and contact data: your name and email address, and your job role and employer where you give them.

- Purchase data: what you bought, when, your billing address, and the payment status. Card details are handled by Stripe and are never seen or stored by us.

- Learning data: your progress through modules, assessment scores, and certificate status.

- Marketing data: whether you opened or clicked our emails, your registration and attendance for our webinars, and your answers to any scorecard or quiz you choose to complete.

- Technical data: IP address and basic device information collected by our platforms.

3. Why we use it, and on what basis

To deliver the course you bought, to take payment, to issue certificates, and to provide support. The legal basis is performance of our contract with you.

To send marketing emails about the course and invitations to our webinars. The legal basis is your consent, given when you joined our list, registered for a webinar, or completed a scorecard. You can withdraw it at any time using the unsubscribe link in any email.

To improve the course, understand which content works, and keep proper business records. The legal basis is our legitimate interests, balanced against your rights.

To meet legal, tax and accounting obligations. The legal basis is compliance with a legal obligation.

4. Who we share it with

We use the following providers, who process personal data on our behalf:

- LearnWorlds, our course platform, which holds your account and learning records.

- Stripe, our payment provider, which processes payments, calculates tax, and holds payment records.

- Kit, our email platform, which holds your email address and engagement data.

- ScoreApp, which holds scorecard and quiz responses where you complete one.

- [WEBINAR PLATFORM NAME], which holds your webinar registration and attendance.

We do not sell your personal data. We do not share it with third parties for their own marketing.

Where an employer purchases a seat block, we may confirm to that employer whether a named learner has enrolled and completed. We do not share assessment scores or individual answers with an employer.

5. International transfers

We are a company registered in the United States and several of our providers are based in the United States. This means your personal data is transferred outside the United Kingdom. Where that happens, we rely on the safeguards offered by those providers, including standard contractual clauses where they apply.

6. How long we keep it

- Course and certificate records: retained while your account is open, and for six years afterwards so that a certificate can be verified.

- Payment records: retained for six years to meet accounting and tax requirements.

- Marketing data: retained until you unsubscribe, and deleted within a reasonable period afterwards.

7. Your rights

You have the right to ask for a copy of the personal data we hold about you, to have it corrected, to have it deleted, to restrict or object to how we use it, and to receive it in a portable format. You can withdraw consent to marketing at any time.

To exercise any of these rights, email jackthornton@performancechefacademy.com. We will respond within one month.

If you are not satisfied with how we have handled your data, you can complain to the Information Commissioner's Office at ico.org.uk.

8. Cookies

We use cookies as described in our Cookie Policy.

9. Changes to this policy

We will update this policy when our processing changes. The version and date below tell you which version applies.
